Terms of Service

These Terms govern your use of Kuutar, a bedtime-routine app operated by NGMI OÜ (“we”, “us”). By creating an account or using the app you agree to these Terms.
1. The service
Kuutar is a gamified bedtime-routine app for children: a “fill-the-moon” checklist, read-aloud illustrated stories, evening tales, and calm soundscapes, managed by a parent or guardian for one or more children.
The app is provided for personal, family use only. It is for entertainment and habit-building — it is not medical, psychological, or sleep-treatment advice.
2. Who may use it
You must be at least 18 years old and able to enter a binding contract to create an account. Children use the app only under the supervision and responsibility of the account-holding adult.
You are responsible for everyone who uses the app through your account, and for keeping the parent PIN and your sign-in credentials confidential.
3. Accounts
You sign in with an email and password, or with Google, through our authentication provider (Supabase). You agree to provide accurate information and to keep your account secure. You are responsible for activity under your account.
You may stop using the app at any time. You can request deletion of your account and associated data by contacting us (see “Contact”).
4. Free trial
New accounts start with a 3-day free trial. No payment method is required, and the trial never converts into a charge by itself — when it ends, the app simply asks whether you want to buy the one-time unlock.
One trial per customer. We may withdraw or change trial terms for future sign-ups at any time.
5. Purchase and billing
Kuutar is sold as a single one-time purchase that unlocks the app for the lifetime of the service — there is no subscription, no renewal, and nothing to cancel. The price is shown in US dollars in the app before you buy; at checkout, Stripe may present and charge an equivalent amount in your local currency.
Payments are processed by Stripe; we do not store your full card details.
We may change the price for future purchases at any time. A price change never affects a purchase you have already made. If you bought a recurring subscription before we moved to one-time pricing, your plan's original terms (including cancellation via the Stripe customer portal) continue to apply to it.
6. Refunds
Because access to the digital service begins immediately after purchase, the one-time unlock is generally non-refundable except where mandatory consumer law requires otherwise. The free trial costs nothing, so you can evaluate the app fully before paying.
“Lifetime” means the lifetime of the Kuutar service, not yours or ours — see “Termination” and “Changes” for what happens if the service is ever discontinued.
Nothing here limits the statutory rights you have as an EU/EEA consumer.
7. Acceptable use
You agree not to misuse the service: no reselling or sublicensing access, no reverse engineering or copying the app or its content, no attempts to break security, scrape data, or disrupt the service, and no use that is unlawful or harmful.
8. Our content and intellectual property
The app, its design, illustrations, stories, sounds, and the Kuutar name are owned by us or our licensors. We grant you a limited, personal, non-transferable, revocable licence to use the app for your family while your account is active.
9. Your content
You provide some content — such as children’s first names, routines, and progress. You keep ownership of it. You grant us the limited licence needed to store and process it to run the app for you, as described in our Privacy Policy.
Please use first names or nicknames only; there is no need to give us more about a child than the app requires.
10. Third-party services
We rely on trusted providers to run the app, including Supabase (sign-in and data storage), Google (Google sign-in), Stripe (payments), and Google Analytics (usage measurement, with consent where required). Your use of those features is also subject to those providers’ terms.
11. Availability and disclaimers
We work to keep the app available and reliable, but it is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond what is described.
The app does not replace parental judgement or professional advice about a child’s sleep, health, or wellbeing.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or your non-waivable consumer rights.
13. Termination
You may stop using the app and cancel at any time. We may suspend or end access if you breach these Terms or to comply with law. We will give notice where reasonable. On termination, the licence in section 8 ends.
14. Changes to the service and these Terms
We may update the app and these Terms over time. If we make a material change, we will take reasonable steps to let you know. Continuing to use the app after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Republic of Estonia, and disputes fall to the competent Estonian courts — without depriving you of the protection of mandatory consumer-protection rules of your country of residence in the EU/EEA.
